What are the steps for Personal Chef Food Mobile Services legal registration? I'm wondering what licensing do I need for Personal Chef.     In addition you will need a federal and a state EIN if you will hire employees. I.e., a SC Federal Tax Id Number ($29)  and a(n) SC  State Employer Tax Number  


    Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Greenville, Incorporate in SC  or form a(n) SC LLC


    Filing a DBA is not required if you will set up an LLC or form a Corporation. If you will do business under your first and last legal name you will not need to get a fictitious business name.

    Catering vs. Personal Chef Service Personal chefs may be chefs that provide catering. Catering is providing food which a personal chef provides. Since caterers prepare food for individuals, health laws and codes protect consumers. You need to comply with these health laws and then obtain a business license.

    The difference between personal chefs and caterers is that a personal chef does not deliver cooked food to his client. A personal chef prepares and cooks the food in the client’s presence in the client's home or place of business. If the personal chef delivers the food to the client, he must also obtain a caterer’s license. That means that the chef must use a commercially approved kitchen by the health department.

    A: So, if you name your food business “Just A Tad Mouth Watering Personal Chef ” you will need to register the name with an assumed fictitious business name DBA filing. Since a food business is prepared food, then you must charge taxes before selling it – unless you sell it wholesale.

    In either case, you will need a wholesale ID also called a resale license to sell the cupcakes wholesale, buy they wholesale or sell them retail in small amounts.

    All food businesses need a re-seller permit because prepared food is taxable.

    This is because any type of prepared food, is a taxable sales event when it takes place. Other than the food seller permit, you will need an occupational Business License and a filing of a fictitious firm name also called a DBA.

    The permits needed for a personal chef in your case are not clear at first sight because you seem to be in the gray zone of personal chef and caterer, but since you prepare and serve the food at in client's homes, you can get away with a business license, an EIN, and a registration of the business name.

    Your business name, "Jordy the Personal Chef," must be registered with a DBA (doing business as) certificate or alternatively with an LLC or corporation.

    In addition, you must have a food safety course certificate that you can usually obtain online for under $10.

    • • Note that in order to sell prepared food as a caterer, you will need to obtain a Seller's Permit tax ID Number, a Business License application -- we will find, complete the application and provide you with the steps to get your food Business License.
    • • In addition, since most likely, you will have a Private Chef trade name for your business, you will also need to register a fictitious business name. Finally, you will need a federal and state employer number for employment withholding for your food handlers employees.
    • • Finally, you can decide to incorporate or form an LLC instead of filing a fictitious business name.
